Plain-English terms for the marketplace that connects overseas property owners with verified local contractors across Jamaica — written to be fair, clear and trustworthy for everyone.

01Acceptance of these terms

These Terms & Conditions (the “Terms”) govern your access to and use of the Tropical Villa Rentals website, applications and services (together, the “Platform”). By creating an account, browsing, or booking or offering a service through the Platform, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree with these Terms, please do not use the Platform. If you are using the Platform on behalf of a company or other organisation, you confirm that you have the authority to bind that organisation to these Terms.

02Definitions

To keep these Terms clear, the following words have specific meanings:

  • “Platform”, “we”, “us” or “our” means Tropical Villa Rentals and the website, apps and services we operate.
  • “Owner” means a property owner or their authorised representative who uses the Platform to find and book services for a Jamaican property.
  • “Contractor” or “Pro” means an independent local service provider who lists and performs services through the Platform.
  • “User” means anyone who accesses the Platform, including Owners, Contractors and visitors.
  • “Booking” means a confirmed request from an Owner for a Contractor to perform a service on a specified date.
  • “Services” means the property-related services offered by Contractors — such as cleaning, gardening, maintenance, electrical work, property management, concierge and transfers.

03Our role: a marketplace, not the service provider

Tropical Villa Rentals is an online marketplace. We connect overseas and local Owners with independent, verified Contractors across all 14 parishes of Jamaica, and we provide the tools to discover, book, pay for and review those services.

We do not ourselves perform any of the Services. Contractors are independent providers, not our employees, agents or partners. When an Owner books a Contractor, the service contract is formed directly between the Owner and that Contractor — Tropical Villa Rentals is not a party to it.

  • We facilitate introductions, scheduling, secure payment and reviews — we do not supervise, direct or control how a Contractor performs their work.
  • We verify Contractors before they go live, but verification is not a guarantee of the quality, safety or legality of any particular job.
  • Owners and Contractors are each responsible for their own conduct and for meeting their obligations to one another.

04Accounts and eligibility

To book or offer Services you must create an account and be at least 18 years old and able to enter into a binding contract. The Platform supports three roles — Owner, Contractor and Administrator — and some features are limited to the relevant role.

  • You agree to provide accurate, current and complete information and to keep it up to date.
  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • Notify us promptly of any unauthorised use of, or security issue affecting, your account.
  • You may not create accounts by automated means, impersonate others, or maintain more than one account in bad faith.

05Contractor verification and obligations

Contractors must be approved by our team before their profile goes live and they can accept Bookings. By listing on the Platform, a Contractor agrees to the following.

  • Provide accurate listings — your services, parishes covered, pricing and availability must be truthful and current.
  • Hold any licences, permits, insurance or qualifications required by law for the work you offer, and perform all work lawfully and to a professional standard.
  • Honour confirmed Bookings, communicate promptly, and treat Owners, their guests and their property with care and respect.
  • Comply with all applicable Jamaican laws, including health, safety and tax obligations relating to your work and earnings.
  • Maintain professional conduct — no harassment, discrimination, or behaviour that endangers people or property.

06Owner obligations

Owners are responsible for giving Contractors what they need to do the job well and safely. By booking through the Platform, an Owner agrees to the following.

  • Provide accurate property details, address and access information, and a clear description of the work requested.
  • Use the Platform only for lawful purposes, and confirm you have the right to authorise work at the property.
  • Arrange timely, safe access for the Contractor on the booked date, and disclose any known hazards at the property.
  • Pay for Services through the Platform and not arrange off-platform payment to avoid fees.

07Bookings, scheduling and cancellations

Bookings are made for a specific date. Where a Contractor offers instant confirmation, your Booking is confirmed immediately for that day once payment is authorised. A confirmed Booking forms a service contract between the Owner and the Contractor.

Cancellations

  • Owners may cancel free of charge up to 24 hours before the scheduled start of a Booking.
  • Late cancellations — made within 24 hours of the start — may incur a cancellation fee or penalty, which protects Contractors who reserved their day for you.
  • Repeated late cancellations or no-shows may result in penalties on your account, including restrictions or suspension.
  • If a Contractor cancels or cannot attend, we will help you rebook and arrange any appropriate refund of amounts paid for that Booking.

Specific cancellation windows, fees and any estimate provided for a job are shown to you before you confirm a Booking.

08Payments, commission and payouts

All payments for Services are made securely through the Platform. We use this single, transparent flow to protect both sides — Owners pay up front by card, and Contractors are paid out reliably after the work is complete.

  • Owners pay securely by card at the time of booking. Card details are handled by our payment processor — we do not store full card numbers on our servers.
  • Tropical Villa Rentals deducts a transparent platform commission from each Booking. The commission and the amount payable are shown to you before you confirm.
  • After a Booking is completed, the Contractor is paid their share by the Platform via bank transfer or Lynk, in accordance with our payout schedule.
  • Prices are set by Contractors. Taxes, where applicable, are the responsibility of the relevant party under Jamaican law.

Arranging or accepting payment outside the Platform to avoid commission is prohibited and may result in suspension or termination of your account.

09Reviews and user content

Honest reviews keep the marketplace trustworthy. You may post reviews, ratings, profile information, messages and other content (“User Content”), subject to the rules below.

  • Owners may leave one review per completed Booking. Reviews must be honest, based on genuine experience, and relate to the Service received.
  • Do not post content that is false, defamatory, abusive, hateful, obscene, infringing, or otherwise unlawful, and do not include others’ personal data without consent.
  • We may moderate, decline to publish, or remove User Content that breaches these Terms — but we do not routinely verify the accuracy of reviews.
  • You retain ownership of your User Content and grant us a non-exclusive, worldwide, royalty-free licence to host, display and use it to operate and promote the Platform.

10Prohibited conduct

To keep the Platform safe and fair, you agree not to do any of the following:

  • Engage in fraud, misrepresentation, money laundering or any unlawful activity.
  • Circumvent the Platform — including arranging off-platform payment to avoid fees, or soliciting users to transact elsewhere.
  • Scrape, crawl, harvest or copy Platform data, or use bots or automated tools without our written permission.
  • Attempt to access accounts, data or systems you are not authorised to access, or interfere with the security or operation of the Platform.
  • Upload malware, harmful code, or files that could damage, disable or overburden the Platform or other users.
  • Harass, threaten, discriminate against, or harm other users, their guests or their property.

11Disclaimers and limitation of liability

The Platform is provided on an “as is” and “as available” basis. Because Contractors are independent providers, we cannot and do not guarantee the quality, timing, safety or outcome of any Service.

  • We are not responsible or liable for the acts, omissions or work of any Contractor or Owner, or for any service contract formed between them.
  • To the fullest extent permitted by law, we exclude implied warranties and are not liable for indirect, incidental, special or consequential losses, or loss of profit, data or goodwill.
  • Where we are found liable despite the above, our total liability arising out of or relating to your use of the Platform is capped, to the extent permitted by law, at the total commission we earned on the Booking(s) giving rise to the claim.
  • Nothing in these Terms limits liability that cannot lawfully be limited — including liability for death or personal injury caused by negligence, or for fraud.

12Indemnity

You agree to indemnify and hold harmless Tropical Villa Rentals and its officers, employees and contractors from and against any claims, damages, losses, liabilities and reasonable costs (including legal fees) arising out of or connected with your use of the Platform, your User Content, your breach of these Terms or applicable law, or any service contract between an Owner and a Contractor.

13Intellectual property

The Platform, including its design, branding, text, graphics, logos and software, is owned by Tropical Villa Rentals or its licensors and is protected by intellectual-property laws. The “Tropical Villa Rentals” name and logo are our trademarks.

We grant you a limited, personal, non-transferable licence to use the Platform for its intended purpose. You may not copy, modify, distribute, reverse-engineer or create derivative works from any part of the Platform without our prior written consent, except as permitted by law.

14Suspension and termination

You may stop using the Platform and close your account at any time. We may suspend or terminate your access — with or without notice where appropriate — if you breach these Terms, create risk or legal exposure, or where required to protect the Platform or its users.

On termination, your right to use the Platform ends, but any obligations that by their nature should survive — including payment obligations, indemnities and liability limits — will continue. We will settle any payouts properly due to Contractors in accordance with these Terms.

15Changes to these terms

We may update these Terms from time to time to reflect changes to the Platform, the law or our practices. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Platform after changes take effect means you accept the revised Terms.

16Governing law and contact

These Terms are governed by the laws of Jamaica, and the courts of Jamaica have jurisdiction over any dispute arising from them or from your use of the Platform, without prejudice to any mandatory rights you may have under applicable consumer law.
